Oracle Corp. (ORCL) is seeking billions of dollars in damages in a patent- and copyright-infringement lawsuit against Google Inc. (GOOG) that claims the search-engine company’s Android software uses technology related to the Java programming language, according to court papers.
The extent of the claims was disclosed yesterday in San Francisco federal court by Oracle, as it sought to prevent Google from filing under seal documents in the case stating Oracle’s monetary claims.
“Oracle’s damages claims in this case are in the billions of dollars,” the company said in a filing, arguing that its demands “are based on both accepted methodology and a wealth of concrete evidence.”
“They should not be hidden from public view,” Oracle said.
Oracle got Java when it bought Sun Microsystems. I would expect that any legal battle might takes years to resolve. But someone must think they have a case.

Shares of Pandora Media (P) are up $2.54, or 16%, at $18.54, having given up more than half the bounce they experienced during the earlier part of the session, when the stock rose as high as $26 after pricing last night at $16.
No need to wait for the underwriters to chase the stock: Maxim Group’s John Tinker has a note initiating coverage this morning, with a Buy rating and a $23 price target.
“Pandora only has 3% of all radio listening – suggesting a lot of runway,” writes Tinker, and he thinks the company will increase share by producing a better advertising product: “Advertisers appreciate the service, as display ads can be offered in an immersive experience where listeners actively participate.” Most of the business is based on ads, while only 2.4% of users actually pay Pandora the $36-per-year subscription, he notes.

In addition, the white paper revealed that overall spending on offshore shopping by all mainland tourists surged 91% and accounted for 17% of the global duty free shopping receipts. Foreign watches, jewelrey and designer clothes were the top three items on their shopping lists.

La croissance de Facebook est-elle en train de baisser ? A en croire les données du site Inside Facebook, le réseau social en ligne commencerait à perdre des utilisateurs sur plusieurs de ses marchés historiques.
Les analystes, qui s'appuient sur l'outil publicitaire de Facebook pour établir leurs statistiques, ont ainsi décompté 149,4 millions d'utilisateurs actifs aux Etats-Unis le mois dernier, soit 6 millions de moins qu'en avril. Le nombre de membres aurait aussi légèrement reculé au Royaume-Uni et au Canada.
Avec 687 millions d'utilisateurs actifs, l'audience de Facebook s'afficherait toutefois toujours en hausse dans l'ensemble du globe (+11,8 millions en un mois), grâce à une popularité grandissante dans des pays émergents comme le Mexique (+1,9 million), le Brésil (+1,9 million) ou encore l'Inde (+1,7 million).
Ces chiffres non officiels doivent évidemment être pris avec précaution. En effet, la notion d'utilisateur actif reste floue et Inside Facebook ne détaille pas sa méthode de calcul. Ces données devront aussi se confirmer sur plusieurs mois pour marquer une vraie tendance. D'autant que d'autres mesures d'audience, comme celle de comScore, n'ont pas décelé de baisse aux Etats-Unis lors du même mois.
Cela constitue toutefois un avertissement pour la société fondée par Mark Zuckerberg. "Lorsque l'audience de Facebook atteint 50% de la population d'un pays, sa croissance commence à ralentir", note Inside Facebook.
Pour trouver des relais de croissance, le site lorgne notamment la Chine et ses plus de 450 millions de personnes connectées à Internet. Censuré dans l'Empire du Milieu, le groupe songerait à créer un réseau social en partenariat avec le moteur de recherche local, Baidu.

Buffett lunch auctioned for $2,345,678

It wasn't a record, but $2,345,678 is still a lot of money for lunch with nine people -- even if one of them is billionaire investor Warren Buffett.
The apparent winning bid in the 12th annual lunch with Buffett was announced Friday at a fundraising event in San Francisco. The winning bid was made Monday, when an anonymous bidder topped the previous offer by $100, resulting in the bid of sequential ascending numerals that held up for the remaining four days of bidding.

Robert Shiller told Reuters that he would not be surprised to see home prices fall another 10 to 25%. If Shiller is right in his prediction, that may be extremely bullish for the U.S. dollar as deflation ravages the economy.
Deflation means an appreciating dollar. Though investors may see falling housing prices as a negative for future economic growth in the U.S., and therefore the U.S. dollar, the dollar has the unique advantage of being the world's reserve currency.
If growth in the U.S. slows, as it appears to be doing, that may be likely to rally the dollar, like in 2008. If investors see weakness in the broader U.S. economy, they may flee to cash to shield themselves from taking losses in equities.
Of course, the Federal Reserve could have a hand in preventing this scenario from playing out. Though the Fed has thus far denied the possibility of a QE3, Chairman Ben Bernanke has shown his willingness to intervene in the market when deflation remains a risk.

Bullish: Traders who believe that Shiller is right and anticipate falling home prices might want to consider the following trades:
Buy PowerShares DB US Dollar Index (NYSE: UUP). UUP is a long play on the U.S. dollar.
Short SPDR S&P Homebuilders (NYSE: XHB [FREE Stock Trend Analys]. XHB attempts to return a value based on the performance of homebuilding companies.
Bearish: Traders who believe that Shiller is exaggerating the problem, or that Bernanke would step in to prevent such an occurrence, may consider taking positions in the following:
iShares Dow Jones US Real Estate (NYSE: IYR) is an ETF which attempts to return a value corresponding to the real estate market..
SPDR Gold Trust (NYSE: GLD) is long play on gold. If the Fed increases liquidity to prevent another housing slump, gold may rally.

Exxon Mobil Corp announced it found the equivalent of 700 million barrels of oil beneath the Gulf of Mexico, the biggest discovery in the region in 12 years.
The estimated size of the Hadrian field may increase as drilling continues, Exxon said in a statement today. The discovery is about 250 miles (400 kilometers) southwest of New Orleans in 7,000 feet of water.

Ford’s valuation is attractive at about 7-times forward earnings...F.nyse continue de payer ses dettes...son "brand" est le plus solide sur le marché présentement et en avril dernier la compagnie a annoncer son meilleur trimestre en 13 ans.

Rochdale Securities ...BAVEUX !

Banking giant Wells Fargo & Company on Monday caught a big downgrade from analysts at Rochdale Securities.
The firm said it cut its rating on WFC from “Neutral” to “Sell,” noting the company will be hampered by slower GDP growth. WFC shares have fallen more than 13% year-to-date, compared with a 3% uptick in the benchmark S&P 500 Index.
